Schurr's legal team attempting to get civil suit dismissed

GRAND RAPIDS (WOOD-AM) - Attorneys representing the former Grand Rapids police officer charged with killing Patrick Lyoya last year are claiming qualified immunity in a new filing that requests the dismissal of a civil suit.

The lawsuit is separate from a pending criminal trial, where Christopher Schurr has been charged with second-degree murder. It alleges Schurr used excessive force and violated Lyoya's rights.

"Schurr is entitled to qualified immunity because the videos demonstrate that Plaintiff cannot plead a constitutional violation nor a violation of clearly established law," the motion said.
